| 1. Application of the terms |

| The stated terms of the ‘Allgemeinen Geschäftsbedingungen’ (AGB) apply to all contracts made with the Hotel ATLAS , in so far as they comply with the criteria as stated by the AGB. In individual cases you can be issued with the terms with which to comply. The AGB (general terms of business) hang clearly and visibly in the hotel and with the agreement of guest or contractor can be specially issued. |

| 2. Guest Contract |
| |
| The criteria are the respective pricelists with the respective charges and service descriptions. The contract for guests (lodging contract) can be written, spoken, spoken from afar, or can be through agreed upon conditions. The terms of contract for guests binds both parties to the fullfilment of the contract, irrespective of the duration of the contract. With overnight stays, the contract is made as soon as the room is ordered and accepted or – if for reasons of time an acceptance was not possible – has already been allocated. |

| 3. Reservations |
| |
| When rooms or other services (e.g. Meals) are reserved on an Options basis, then the Options dates for both parties to the contract are binding. After the Options period has run out the Hotel ATLAS without notice freely offer the room and services in the Option. Reserved and confirmed rooms of the Hotel ATLAS are available from 15.00 hours on day of arrival and until 12.00 hours on day of departure.The Hotel ATLAS is entitled, after 18.00 hours on the day of arrival, to make other arrangements for the room, so long as an expressly agreed upon later time of arrival was not made. |

| 4.Price changes |

| After the contract is made, the agreed upon price can be changed by the Hotel ATLAS, in accordance with valid price list changes, if the time lapse between making of contract and the provision of services amounts to more than 4 months. |

| 5. Terms of payment |
| |
| Invoices are, so long as no other expressed arrangements for payment were agreed, payable immediately as the bill is issued, without any reductions, and in cash for the amount due. The acceptance and the choice of credit cards is always at the discretion of the Hotel ATLAS and this stands even when the acceptance of specific credit cards is shown on a sign in the hotel. The acceptance of credit cards and special means of payment ensues only from the recipient. (not sure about ERFÜHLUNGSHALBER)With payment arrears arising from the issue of the first bill, the Hotel ATLAS is entitled to withhold all further and future services for the guest, assuming that the Hotel ATLAS, through a reminder, pointed out the time period set out for payment and referred to the consequences following on from non-payment. If the total amount of the bill exceeds ¤ 250,- or if a guest stays longer than six days in the hotel, then the Hotel ATLAS is entitled, in each case, to present an intermediate bill and to ask for payment from the guest. |

| 6. Advance payments |
| |
| In the case of a guest,who has not made a reservations, the Hotel ATLAS is entitled to ask for advance payment of the amount of an overnight price when the contract is made. The Hotel ATLAS can, without taking any booking acceptance, make the acceptance dependent on the advance payment, of the full or partial estimated amount for the reservation or services carried out or to be continued, in the form of prepayments, advance payments, or complete forward payments. |

| 7. Cancellations, Cancellation charges |
| |
| Cancellations can be made until 6:00 p.m. (local time) on arrival day. After this we charge 80% of the booked room rate for the first night. |
| No charges appear, if the room can be rented otherwise on arrival day. |

| 8. Liability |
| |
| For the liability of the Hotel ATLAS, §§701-703 of the ‘Bürgerlichen Gesetzbuches’ (BGB) are binding. There can be no other reason for liability except when the damage was caused by the Hotel ATLAS, whose statutory representative or assistants wilfully, carelessly or accidentally brought it about. |

| 9. Withdrawal by the hotel |
| |
| a.) The hotel can not unilaterally withdraw from the agreed contract. Exceptions are in the case of outbreak of violence or strike. |

| b.) The hotel is obliged, if unable to allocate the guest a room, to make available an equivalent room in an equivalent price category. |
| |
| 10. Other provisions |
| |
| The laws of the German Republic are binding for these terms and for the the entire legal relation between the Hotel ATLAS and the guest. |
